General Terms and Conditions (GTC) of Turm E-Commerce AG
1. Scope
These General Terms and Conditions (hereinafter " GTC ") apply to all orders placed via the online shop https://shop.turmkaffee.ch/ of Turm e-commerce AG and to all bookings of events and courses made via the website www.turmkaffee.ch of Turm Handels AG. When you (hereinafter "you" or " customer ") purchase products via the online shop, the contract is concluded between you and Turm e-commerce AG. When you book events or courses, the contract is concluded between you and Turm Handels AG (hereinafter referred to as Turm e-commerce AG and Turm Handels AG together as the " Turm Group ").
By submitting an order or booking, the customer expressly agrees to these Terms and Conditions . All orders and bookings are processed by the Turm Group solely on the basis of these Terms and Conditions. Any deviating and/or supplementary agreements require the express written consent of the Turm Group.
By placing an order and making a booking, the customer accepts our delivery and payment terms. Shipping usually takes place within 1 to 3 business days after receipt of payment. There is no minimum order value. We expressly reserve the right to restrict the availability of certain products.
3. Prices, shipping and customs costsPrices include VAT. Shipping costs are not included in the prices shown and will be charged separately. For deliveries within Switzerland and Liechtenstein, a flat shipping fee of CHF 9.90 will be charged. Orders over CHF 90.00 qualify for free shipping. Special requests (e.g., express delivery) will always be charged separately. For deliveries to locations outside of Switzerland and Liechtenstein, the customer will be charged the actual shipping costs. Customs duties may also apply to goods exported abroad. These customs duties are also the responsibility of the customer.
4. PaymentWe accept Mastercard, Visa, Twint, and PayPal. When paying by credit card, the total order amount, including VAT and shipping costs, will be charged on the day the order is received. For credit card payments, after completing the order in our shop, the customer is automatically redirected to the Turm Group's payment provider. The customer enters their credit card details securely on the payment provider's website. No credit card data is stored by the Turm Group. The customer's card will be charged including shipping costs and VAT.
Purchase on account with partial payment option (POWERPAY)
MF Group / POWERPAY, as an external payment service provider, offers the payment method "purchase on account." With a single invoice, you can easily pay for your online purchase by invoice. If you do not pay within the specified timeframe, you will subsequently receive a monthly statement with an order summary in the following month.
Upon conclusion of the purchase agreement, POWERPAY assumes the resulting invoice claim and handles the corresponding payment processing. When purchasing on account, you accept POWERPAY's terms and conditions in addition to our own. https://terms.mfgroup.ch/agbfiles/Powerpay_Checkout_de.pdf
Subscription orders can only be paid for by credit card and PayPal.
Delivered items are not returnable. In case of obvious defects, the purchase price will be reduced or, at the customer's request, a replacement will be provided.
6. ComplaintsThe customer must inspect the received goods immediately upon receipt. Delivery is considered approved after 5 days from receipt of the goods. No compensation will be provided for damage resulting from improper storage and/or improper use or consumption.
7. LiabilityThe Turm Group accepts no liability for non-delivery or delayed delivery of products due to an incorrectly declared delivery address, absence of the recipient and/or customs problems (export).
B. ADDITIONAL PROVISIONS FOR EVENTS AND COURSES8. Registration
Registration for events or courses must be done in writing (e.g., letter, fax, email or directly online via the Turm Handels AG internet platform (www.turmkaffee.ch)) and will be confirmed by email upon receipt.
9. Registration deadlineThe registration deadline is usually one week before the event or course begins.
10. ImplementationAfter the registration deadline, Turm Handels AG decides whether the course or event will take place based on the number of registered participants (minimum number of participants). Turm Handels AG reserves the right to cancel events if the minimum number of 6 participants is not reached or if the event cannot be held due to force majeure. In this case, payments made by the customer will be refunded or, at the customer's request, credited towards another course offered on www.turmkaffee.ch .
11. Costs/Payment TermsThe costs for customer participation in events or courses are detailed in the tender documents. These costs are payable before the start of the event or course.
12. Cancellation, withdrawal or terminationCancellations must be made in all cases by email to info@turmkaffee.ch or by telephone to +41 71 288 17 35. Unless otherwise stated in the individual announcements or on the confirmation, the following rule applies:
No cancellation fee will be charged up to one month before the start of the event or course.
A processing fee of CHF 100.00 will be charged for cancellations made by the customer up to one week before the start of the event or course.
For cancellations made by the customer up to three days before the start of the event or course, the customer must pay 50% of the event or course costs, or at least CHF 100.00. For cancellations received by Turm Handels AG less than one day before the start of the event or course, the customer must pay the full event or course costs.
If the customer cancels after the start of the event or course, fails to appear, or cancels the event or course, they must pay the full cost of the event or course.
Insurance is the responsibility of the customer participating in the course or event. Turm Handels AG accepts no liability for personal injury and/or property damage. Customers are advised to take out course and cancellation insurance.
14. Changes to the event and course offerings as well as price changesChanges to the event and course offerings as well as price changes are reserved.
C. ADDITIONAL PROVISIONS FOR SUBSCRIPTION CONTRACTS15. In our shop, under the category "Subscription," we offer the option of subscribing to a coffee or tea service, i.e., receiving your favorite varieties regularly, subject to the following terms and conditions. Apart from a discount code or gift voucher used when setting up the subscription, no other discounts are available for our subscriptions.
16. To create a personalized subscription, the customer can select their desired coffee or tea variety and package size, and add it to their shopping cart by clicking the "Add to subscription" button. Under the "Select delivery interval" tab, the date of the first shipment and the desired delivery interval for subsequent shipments can be configured.
17. When a subscription is ordered, Turm e-commerce AG will confirm receipt of the order to the customer via email. However, this confirmation does not yet constitute acceptance of the contract. A purchase agreement is concluded as soon as the customer receives written notification from Turm e-commerce AG confirming the subscription.
18. Payments due for subscription deliveries are payable on the respective shipping date.
19. A subscription can be cancelled at any time without giving reasons. To do so, the customer can click the "Cancel subscription" button in the customer area under the "Cancel subscription" category. The customer also has the right to change the shopping cart, the delivery interval, or any customer details at any time free of charge, or to pause individual deliveries. The shopping cart and the delivery interval can be adjusted until the day before (midnight) of the next scheduled delivery date. Turm e-commerce AG also reserves the right to cancel the subscription at any time.
20. Our coffee and tea products are subject to natural price fluctuations, which is why our sales prices may change during the term of the contract. Price changes will be communicated to the customer by email. If the customer agrees to the price change, it will apply to all future subscription deliveries from the date of agreement. If the customer does not agree to the price change within 10 days, Turm e-commerce AG may terminate the subscription by email in accordance with section 19.
21. In exceptional cases, it may happen that the coffee or tea variety ordered as part of a subscription is no longer available, particularly if it is discontinued or has been removed from the product range. In this case, Turm e-commerce AG is entitled, after prior notification, to replace the affected coffee or tea variety with a similar or equivalent coffee or tea variety in the same price range.
D. DATA PROTECTION AND FINAL PROVISIONS22. Data protection
The type, scope and purpose of the processing of the customer's personal data by the Turm Group are set out in the privacy policy.
23. Changes to these Terms and ConditionsThe Turm Group reserves the right to amend these Terms and Conditions at any time. The currently valid version of these Terms and Conditions will be published on the website www.turmkaffee.ch and in the online shop, accessible at https://shop.turmkaffee.ch/ . Upon publication, the customer is deemed to have accepted the amended Terms and Conditions, provided that the amendment is solely to the customer's advantage and/or does not disadvantage the customer. In all other cases, the amended version of these Terms and Conditions will apply from the customer's first order or first event or course registration after publication of the amended Terms and Conditions on the website or in the online shop.
24. Applicable Law and Jurisdiction24.1 Unless the law of another state or the law of the European Union is mandatory, the provisions of Swiss substantive law (excluding the UN Convention on Contracts for the International Sale of Goods) shall apply to all contracts and the customer relationship between the Turm Group and the customer, even if orders are placed from abroad, goods are delivered abroad, or courses or events are booked from abroad and/or held abroad.
24.2 Subject to any other legally mandatory places of jurisdiction, the place of jurisdiction for all disputes arising from a contract or the customer relationship between the Turm Group and the customer is agreed to be St. Gallen, Switzerland.
25. Severability ClauseShould any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected. Any verbal agreements are deemed invalid and require written confirmation to be valid.
